I understand that during use of the designated trails made available to me as a member of the Lake Arrowhead Hiking Club (“LA Hikers”), certain risks and dangers may arise including, but not limited to, hiking or traveling in remote areas, animals, forces of nature, accident and illness.
Lake Arrowhead does not undertake and does not have any responsibility for the accuracy of any information it provides or to determine or assure the suitability of any hike or any other event or activity of the Lake Arrowhead Hiking Club, in general or as to a particular person. I understand that this property may not be actively maintained, and I assume all risk associated with the natural condition of the property.
Lake Arrowhead has no duty to provide medical assistance or advice to any hiker. All persons who utilizes private property made available for hiking through the Lake Arrowhead Hiking Club, or participates in any hike or other activity accepts responsibility for making their own determinations as to the suitability of the activity and for their own safety, conduct and wellbeing and agrees to participate solely at their own risk.
In consideration of the right to participate in any hikes, use private property as designated by the Lake Arrowhead Hiking Club or other activities of the Lake Arrowhead Hiking Club, I, the undersigned, assume the risk associated with these activities and will hold the Lake Arrowhead Hiking Club, Lake Arrowhead Yacht & Country Club, Inc., Lake Arrowhead Communities, LLC, The Johnson Development Companies, LP, Johnson Development Company Georgia, LLC, the Purcell Co., Inc., JV Ventures, LLC, and any other related entities, its officers, partners, members, shareholders, directors, hike leaders and agents (collectively “Released Parties”) harmless from and defend them against any and all liability, actions, suits, claims and demands which could arise from any of the Club’s activities and from any loss or injury which I may sustain as a result of my participation in any of these activities.
WILDLIFE WARNING: Lake Arrowhead contains (or is adjacent to) a number of man made, natural and environmentally sensitive areas. These areas include, among other things, various wetlands, streams, woodlands, and lakes. These areas may serve as habitats for a variety of native plants and wildlife including, without limitation, wild animals, wild boar, black bear, deer, insects, ticks, chiggers, mosquitoes, venomous and non-venomous snakes, and other reptiles, some of which may pose hazards to people, pets, or property coming into contact with them.
Each LA Hiker (i) acknowledges that such plants and wildlife are indigenous to the area and are not restrained or restricted in their movements within or throughout Lake Arrowhead and (ii) assumes all risk of personal injury and damage to property arising from the presence of such plants and wildlife. The areas described in the paragraph above may also contain creeks, streams, ponds, intermittent pools of water, muddy areas and underbrush, among other things, all of which are important to the ecological balance and maintenance of the area and no Hiker may use or enter upon such areas in violation of (i) these rules and any applicable rules and regulations adopted by Lake Arrowhead Hiking Club and Lake Arrowhead Yacht & Country Club from time to time or (ii) any applicable governmental laws, rules, regulations, and ordinances.
Further, I, for myself and my heir, executors, administrators and assigns, hereby release, waive and discharge the Released Parties and Lake Arrowhead Yacht and Country Club, Inc., and its owners, officers, directors, employees, agents and volunteers of and from any and all claims which I or my heirs, administrators and assigns ever may have against any of the above for, on account of, by reason of or arising in connection with the LA Hikers or my participation therein, and hereby waive all such claims, demands and causes of action.
Further, I expressly agree that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the State of Georgia, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I currently have no known mental or physical condition that would impair my capability for full participation as intended or expected of me.
Further, I have carefully read the foregoing release and indemnification and understand the contents thereof and sign this release as my own, free act, and that I am eighteen (18) years of age or older.
Any minor, under the age of eighteen (18), may access trails only under the supervision of an adult Hiking Club Member. As a Hiking Club Member, I accept full responsibility for the supervision and safety of any minors and/or non-hiking club individuals accompanying and invited by me.
By my signature below I agree to all aspects of this disclaimer, have received, read and agree to abide by the rules and regulations of the Lake Arrowhead Hiking Club, and understand that those rules and regulations may be amended at any time. I further understand that participation in the Lake Arrowhead Hiking Club requires that my Lake Arrowhead Yacht & Country Club account must remain in good standing at all times, and any rights and privileges associated with the Lake Arrowhead Hiking Club may be terminated unilaterally at any point in time by the Lake Arrowhead Yacht & Country Club for any reason. I further assume full responsibility for any invited minor or adult guest accompanying me on the Lake Arrowhead trails, and understand that it is my duty and obligation to fully inform them of all rules, regulations, safety and other information provided to me as a Hiking Club member.
